Ostracizing Criminals
A person who knowingly commits a crime should be osrtracized
On a very high level using a very coarse granuality and classifying human deeds as only right or wrong, one might agree with the above statement. I do completely agree to the fact that commiting crimes disregarding all moral scruples is an felony. But, we cannot simply ignore the multitude of factors that finally result in people committing crimes. Some of these factors include social deprivation, lack of education, lack of schooling and sometimes lack of love.So a general rule that simply ostracizes the felon won't work. Its just proved by the irony that human race though sophisticated and developed hasn't decided on a world wide common judicial system. This is because all humans are not the same, resulting in fact that all societies or human groups are different in terms of thier toleration level. For a society X what may term to be a felony may just be an peccadillo in society Y. A perfect example is polygamy which is a felony is most western states and it is not even a crime in some countries.
The fact that society has applied a whole lot of stringent punishments for criminal hasn't resulted in a perfect state, and for the least has not dettered criminals from commiting crimes. A perfect example of this dictatorial regimes, where most of the dictators impose the most tyrannical of rules. I most of such case the dictator policing moral conduct eventually becomes the most hated tyrannical criminal.
On the other side societies have also chosen to be completely libral about crimes and criminals. These are the places where capital punishment is banned,all criminals are given all sorts of support by human right groups etc.But still here too we are still eluded from etopia the perfect state.
People always have been committing crimes right from biblical ages.The first crime ever commited was a murder where a Abel killed his brother Kane and the latest crimes may just be happening in the neighbourhood right now. We must admit to the fact that the human race has failed in stopping criminals from commiting crimes. Here iam writing an essay, and i really don't claim to present ideas which when implemented will make the world crime free. I me or anybody else claims so, he is fooling himself more than anybody else.
Is there a solution? Lets analyze the given solution of ostracizing the criminal. I will compare this solution to a solution where we are actually running away from the problem rather than solving it. Ostracizing the criminal won't allow the human race to understand the root cause of people commiting crimes. Researching and understand the cause of a problem i think is the first step in solving any problem. By keeping the criminal off the city limits we have loose an golden opportunity of discovering the root cause of the crime.
People may contend that keeping the criminal away from the society actually will protect the society as a whole. I will not agree with them because this approach, will surely stop one criminal from commiting crime but it provides not guarantee that there won't be a new criminal born out of ignorance and circumstances that will be still present in the society itself.
I would like to restress my point, that a through investigation of the root cause of a crime is important. This serves two very important purpose of stopping the criminal mentality by designing proper education and political systems. And Secondly it gives the criminal a chance to understand his mistake. Its only when the criminal has understood his mistake he repents for the crime and atones with the society, i think true justice is served.
And ofcourse there has to be an liberal "deterministic" upper bound on the number of chances that are provided for regeneration for a criminal. After this , if the criminal is still not showing any signs of contrition, the criminals case must be closed marking the criminal as mentally deranged person and pshychiatric help may be seeked for him.
